4. PRICING POLICY, ORDERS YOU PLACE AND DELIVERY
At JackWills.com, our commitment is to offer convenience, service, and product availability on-line at compelling prices every day, with certain limited time offerings of merchandise at promotional prices. The prices displayed on this website are quoted in U.S. currency and are valid only in the United States. Prices are subject to change at any time. Relevant sales taxes, if any, shall be applied at checkout. No contract for the sale of any product will exist between you and jackwills.com until we accept your order by shipping the product to you. The price of any item is not guaranteed until the item has been shipped to you. When this happens, we will confirm our acceptance of your order by sending you an email informing you that your order has been dispatched. If the price of a product you have ordered should change prior to shipment, you will be notified by email that your order has not been accepted by us and will not ship. You may re-order the item at the adjusted price if you wish. This confirmation email will be sent to the email address given in your order form and will detail products ordered, payment method, cost (including sales tax and S&H) and usual delivery times. You must check that all the details on this confirmation email are correct and contact us as soon as possible if any details are incorrect. If your order has not been accepted, you may not receive an explanatory email from us detailing the reasons why. This could be due to fraud or security checks on the order you have placed. Please contact our Customer Services if you have an further questions. The stated delivery period within which you will receive your order is approximate. Goods will be sent to the address given by you in your order. If you are ordering more than one item, your goods may be sent to you in installments if certain items are out of stock. You may be subject to import duties and taxes, which are levied once a shipment reaches your country. You must meet any additional charges for customs clearance. Please note; customs policies vary widely from country to country. We recommend you contact your local customs office for further information prior to placing your order. Please note international shipments may be subject to cross-border inspections by customs authorities. Jack Wills is not responsible for any additional duty payments on arrival.

We have done our best to display as accurately as possible the colors of the products shown on the JackWills.co.uk web site. However, because the colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will be accurate.
7. CORRECTION OF ERRORS AND INACCURACIES
The information of the JackWills.com web site may contain typographical errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change and update information at any time without prior notice (including after you have submitted your order). Please note that such errors, inaccuracies or omissions may relate to product description, pricing and availability. We apologize for any inconvenience this may cause you. 8. TYPOGRAPHICAL ERRORS
In the event an JackWills.com product is listed at an incorrect price due to typographical error or systems error, JackWills.com shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. JackWills.com shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, JackWills.com shall issue a payment to your credit card account in the amount of the incorrect price.
9.TERM; TERMINATION
These terms and conditions are applicable to you upon your accessing the site/ or completing the registration or shopping process. These terms and conditions, or any of them, may be terminated by JackWills.com without notice at any time for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Please note that you must be 18 years or older to register with the Site and to purchase goods from the Site. By registering to use the Site you warrant that you are aged 18 years of age or older.
13. COMMUNICATIONS FROM JACK WILLS
If you are registered on our customer database you may receive email or postal communications from time to time. We only want to send you communications if you are happy to receive them and will be pleased to address any request to be removed from our mailing list. At Jack Wills we take data quality and your privacy very seriously so if you would like to change your details or remove yourself from our mailing list please log into the 'my account' section and edit your preferences. If you would like to remove yourself from our email list you can follow the same process or just click the 'unsubscribe' link at the bottom of our emails. From time to time Jack Wills will use a 3rd party to send communications to you. Therefore, if you request to be remove from future communications it may take up to 30 days to fully be removed. In this instance, we would like to thank you for your patience.
14. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Jack Wills Limited, its officers, directors, employees, agents, licensors and suppliers (collectively the "Service Providers") from and against all losses, expenses, damages and costs, including reasonable attorney's fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.

In an attempt to provide increased value to our visitors, JackWills.com may choose various third-party web sites to link to from its own site. However, even if the third party is affiliated with Jack Wills Limited, has no control over these linked sites, all of which have separate privacy and data collection practices, independent of Jack Wills Limited has no responsibility or liability for these independent policies or actions and is not responsible for the privacy practices or the content of such web sites. These linked sites are only for your convenience and therefore you access them at your own risk. None the less, Jack Wills Limited seeks to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its site, but for sites it links to as well (including if a specific link does not work).
16. COMPETITIONS
PARTY PANTS
Competition ends 10.05.09. Open to US residents only. No terms necessary. Winners will be selected by Jack Wills on a first come first served basis. Jack Wills decision is final. No cash alternative. Party Pants will be delivered within 28 days of being chosen a winner. Only open to those who supply two valid email addresses.
VARSITY POLO COMPETITION
You must be 18 years of age and over to enter the competition. Jack Wills Ltd retains the right to use collected information from competition entries for future marketing purposes. Collected data will not be shared with any 3rd parties. Both competitions are offering to give away 2 pairs of tickets to 2 people. That means 2 people will win a pair of tickets, 1 ticket for themselves and a second to take a family member/friend. All winners must agree to write a blog both before and after the Varsity Polo 2009. The draw will be at randomn, Jack Wills’s decision is final. Jack Wills retains the right at all times to cancel the terms of the competition, including flights, accommodation and the tickets. All winners must ensure they are fully insured for international travel. Personal belongings and illness/injury will not be covered by Jack Wills Ltd. Jack Wills Ltd will not cover expenses outside of the Varsity Polo day and pre-party at Mahiki. E.g. travel around London and entertainment is at your own expense. 17. DISCLAIMER
This site and the materials and products in this site are provided "as is" and without warranties of any kind, whether express or implied. To the fullest extent permissible pursuant to applicable law, jack wills limited.
